All school staff must comply with Victorian privacy law and the Schools\u2019 Privacy Policy<\/a>. This notice explains how the Department, including Victorian government schools (schools), handles personal and health information. On occasion, specific consent will be sought for the collection and use of information, for example, for a student to receive a health service. Our schools are also required by legislation, such as the Education and Training Reform Act 200<\/a>6, to collect some of this information.<\/p>\n

In Victorian government schools, the management of\u00a0personal information<\/strong>\u00a0\u0924\u0925\u093e\u00a0health information<\/strong>\u00a0is governed by\u00a0Privacy and Data Protection Act 2014<\/a>\u00a0(Vic) and\u00a0Health Records Act 2001<\/a>\u00a0(Vic) (collectively, Victorian privacy law). In addition, the Department and Victorian government schools must comply with the\u00a0Victorian Data Sharing Act 2017<\/a>.<\/p>\n

This policy explains how Victorian government schools collect and manage personal and health information, consistent with Victorian privacy law and other associated legislation.<\/p>\n

In addition to its obligations described in this policy, the department has limited and specific obligations under national applied law schemes which are set out in the department\u2019s\u00a0Privacy policy (National Law)<\/a>. These additional obligations relate to our role as early childhood services regulator in Victoria, and also in relation to health practitioners who are governed by the Health Practitioner Regulation National Law (Victoria). However, health information collected and managed in Victorian government schools is primarily handled in accordance with the\u00a0Health Records Act 2001<\/a> (Vic) and obligations are, in practice, consistent. \u0935\u094d\u092f\u0915\u094d\u0924\u093f\u0917\u0924 \u091c\u093e\u0928\u0915\u093e\u0930\u0940<\/strong> is information or opinion, whether true or not, about a person whose identity is apparent, or can reasonably be ascertained, from the information or opinion \u2013 that is recorded in any form. For example, a person’s name, address, phone number and date of birth (age). De-identified information about students can also be personal information.<\/p>\n

\u0938\u094d\u0935\u093e\u0938\u094d\u0925\u094d\u092f \u091c\u093e\u0928\u0915\u093e\u0930\u0940<\/strong> is information or opinion about a person\u2019s physical, mental or psychological health or disability, that is also personal information \u2013 whether in writing or not. This includes information or opinion about a person\u2019s health status and medical history, immunisation status and allergies, as well as counselling records.<\/p>\n

\u0938\u0902\u0935\u0947\u0926\u0928\u0936\u0940\u0932 \u091c\u093e\u0928\u0915\u093e\u0930\u0940<\/strong> is information or opinion about a set of specific characteristics, including a person\u2019s racial or ethnic origin, political opinions or affiliations, religious beliefs or affiliations, philosophical beliefs, sexual orientation or practices; or criminal record. It also includes health information.<\/p>\n
